News Room : Denise Richards reveals she’s having surgery as it interrupts bitter divorce battle with ex Aaron Phypers

The Real Housewives of Beverly Hills alum Denise Richards just revealed her plans to undergo surgery next month, which will interrupt her bitter divorce battle against her estranged second husband Aaron Phypers.

The 54-year-old Bond Girl – who’s rumored to have had a facelift in July – ‘will be unavailable for a large portion of’ December, according to legal docs filed Friday which were obtained by Daily Mail.

Richards was responding to the unemployed 52-year-old’s desperate filing last Thursday, which asked the judge for an expedited spousal support hearing within 15 days.

‘I am in literal danger of being made homeless with no vehicle and no cell phone unless the hearing can be advanced to an earlier date and orders can be entered allowing me access to the substantial funds that are being controlled by [Richards],’ Phypers (born Cameron) claimed.

‘My financial situation gets worse by the day. My pickup truck, which is now my only vehicle, is subject to repossession. I am in danger of eviction at any time. I am begging friends for money to have food to eat. I now have criminal charges against me and I need to retain a defense attorney before my next hearing, which is in mid-December.’

The Canadian-American ex-CEO – who has ‘no income’ – asked the Her Wild Things producer-star to pay him $338,686 for unpaid bills relating to his truck, storage units, legal fees, as well as a leased Calabasas home ‘in order to survive.’

When Phypers originally filed for divorce from Richards on July 7 after six years of marriage, he requested spousal support of around $105K/month.

But LA Superior Court Judge Mark Juhas denied the USC grad’s request due to ‘insufficient showing of exigency’ and blamed ‘court congestion’ as well as Richards’ attorney Brett Berman’s packed schedule for the reason his hearing won’t be until January 7.

Berman asked Judge Juhas to fine Phypers $2,000 in sanctions for ‘filing this unnecessary and frivolous ex parte application’ and argued he was ‘only inflaming the situation and causing attorney fees to escalate.’

Their next regular divorce court hearing is scheduled for January 5. 

Last week, Richards spoke out about her divorce for the first time since the judge granted her a five-year restraining order from the former Q360 Club owner.

‘[I’m] good. It’s a process. I have such a great support system. Thank you so much,’ the Illinois-born beauty said during the Bravo2Bravo panel at BravoCon in Las Vegas.

‘Being in the tabloids [is] very daunting. When you first have to deal with it, it’s very hard…it’s different because on the reality shows, our personal life is out there. On reality, you can’t pretend it’s not happening.’

On November 7, Judge Juhas ordered Phypers to stay away from Richards, stop threatening/harassing her, stop sharing nude photos of her and surrender any firearms to police after she accused him of physical abuse.

Phypers has denied ever physically harming the Starship Troopers alum, but he was arrested on October 17 and charged with two felony counts of injuring a spouse (back in 2022) and two felony counts of dissuading a witness by force or threat.

Richards wants Phypers to pay her legal expenses and any expenses related to the alleged abuse, and she requested that he attend a 52-week batterer intervention program.

The ex-couple originally began dating in December 2017 before his divorce from Desperate Housewives alum Nicollette Sheridan was finalized in 2018.

Richards has two daughters – Sami, 21; and Lola, 20 – from her two-year marriage to first ex-husband Charlie Sheen, which acrimoniously ended in 2006.

The Riff Raff executive producer adopted 14-year-old daughter Eloise Joni Richards in 2011 as a single parent.

Richards will next appear on the 15th season of The Real Housewives of Beverly Hills, which premieres December 4 on Bravo.

‘I did a couple episodes coming up,’ The Return to Wickensburg actress confirmed during the ‘Bravo Bravo F’ing Bravo’ Q&A last week.

‘[It’s] just an appearance, not even a “friend of.”‘

When asked if she was negotiating with execs to return to the franchise as a full-time Housewife, Richards teased: ‘We’re talking about things.’
